3. Security Measures: You are not allowed to probe, scan, or test the security of the CRM system or its connected networks. Similarly, you may not compromise the site's security or authentication measures. Reverse lookup, tracing, or any actions intended to uncover information about other users or visitors, or exploit the CRM system or its services to reveal information not belonging to you, is strictly forbidden.
4. Network Load: You agree not to take actions that unreasonably burden the infrastructure of the CRM system or Fedesco's systems and networks, or those linked to the CRM system or Fedesco.
5. Interference: Using any tools, software, or routines to disrupt or attempt to disrupt the proper functioning of the CRM system, including interfering with any transactions, is prohibited. This includes interfering with other users' utilization of the CRM system.
6. False Identity: You may not forge headers or manipulate identifiers to conceal the source of any messages or communications sent to Fedesco through the CRM system. Impersonating someone else or any other entity is strictly forbidden.
7. Legal Compliance: The CRM system and its content may not be employed for unlawful purposes or in violation of these Terms of Use. Soliciting or engaging in illegal activities or actions that infringe upon the rights of Fedesco or others is strictly prohibited.

Your Commitment Regarding the CRM Web Solution

By utilizing our CRM web solution, you agree to comply with any additional terms and conditions that may apply, including affirming that you meet the necessary legal age requirements for using or participating in specific services or features. In the event of a conflict between these Terms of Use and the terms outlined for a particular section of ClientFlow or for any service provided through it, the latter terms will prevail concerning your use of that specific section or service.

Please note that Fedesco's responsibilities, if any, concerning its products and services within ClientFlow are exclusively regulated by the agreements established for their provision. The content on this site should not be construed as modifying these agreements in any manner.

Fedesco, maintains the right to implement changes to any products or services offered through the CRM web solution, including adjustments to the associated pricing, without prior notice. It's important to be aware that the information regarding products and services within ClientFlow may become outdated, and Fedesco does not commit to refreshing this information pertaining to products and services.

Accounts, Passwords, and Security for Clientflow CRM

Certain features or services provided through the Clientflow CRM may necessitate the creation of an account, including the setup of a unique ID and password. You are strictly prohibited from using someone else's ID, password, or account without obtaining explicit permission and consent from the account holder. Fedesco bears no responsibility for any losses or damages arising from your failure to comply with these obligations.

To access Fedesco's Privacy Policy, please follow the provided link on the website. Moreover, by utilizing the Clientflow CRM, you acknowledge and consent to the fact that Internet transmissions are never entirely private or secure. It is essential to understand that any messages or information you transmit to the CRM may potentially be accessed or intercepted by third parties, even if there is a notification indicating that a specific transmission, such as credit card information, is encrypted.

Fedesco makes the following disclaimers concerning the ClientFlow CRM:

• Fedesco does not guarantee that the CRM platform or any of its content, services, or features will be error-free or uninterrupted. It does not assure that any defects will be rectified, or that your use of the CRM platform will produce specific results. The CRM platform and its content are delivered on an "as-is" and "as-available" basis. All information provided on the CRM platform is subject to change without notice.
• Fedesco cannot guarantee that any files or other data you download from the CRM platform will be free from viruses or contamination or that they will not contain destructive features.
• Fedesco disclaims all warranties, whether express or implied, including warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose.
• Fedesco disclaims any and all liability for the actions, omissions, and conduct of any third parties related to or in connection with your use of the CRM platform and/or any Fedesco services.
• You assume full responsibility for your use of the CRM platform and any Linked Sites. Your sole recourse against Fedesco for any dissatisfaction with the CRM platform or any of its content is to discontinue using the CRM platform or such content. This limitation of relief is an integral part of the agreement between the parties.

The above disclaimer extends to any damages, liabilities, or injuries resulting from any performance failure, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, computer viruses, communication line failures, theft, or unauthorized access to, alteration of, or use, regardless of whether it arises from breach of contract, negligence, or any other cause of action.

Limitation of Liability

Except where prohibited by law, Fedesco shall not be liable to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if Fedesco has been advised of the possibility of such damages.

Fedesco cannot and will not be held accountable for any financial losses, whether real or implied, incurred due to system downtime or the actions of third-party integrated service providers. These circumstances lie beyond our control.

In the event that, despite other provisions in these Terms of Use, Fedesco is found to be liable to you for any damage or loss arising from or connected to your use of the ClientFlow CRM or any Content, Fedesco's liability shall not exceed the greater of:

• The total subscription or similar fees paid for any service or feature on the CRM platform in the two months prior to the initial claim made against Fedesco (excluding the purchase price for any Fedesco hardware or software products or any Fedesco Care or similar support program).
• ZAR1500.00.

Indemnity

You agree to indemnify and hold Fedesco, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates harmless from any demands, losses, liabilities, claims, or expenses (including attorneys' fees) made against Fedesco by any third party due to, arising out of, or in connection with your use of the ClientFlow CRM.

Violation of These Terms of Use

Fedesco may disclose any information it possesses about you, including your identity, if such disclosure is deemed necessary in connection with any investigation or complaint regarding your use of the ClientFlow CRM. This includes the identification, contact, or legal action against any individual causing harm or interference (whether intentionally or unintentionally) with Fedesco's rights, property, or the rights and property of CRM platform visitors or users, including Fedesco's customers. Fedesco reserves the right to disclose such information at all times if required to comply with applicable laws, regulations, legal processes, or government requests. Additionally, Fedesco may disclose your information when it deems that applicable law necessitates or permits such disclosure, including sharing information with other companies and organizations for fraud protection purposes.

You acknowledge and consent that Fedesco may preserve any communication between you and Fedesco through the ClientFlow CRM and may disclose such data if required by law or if Fedesco determines such preservation or disclosure is reasonably necessary to:

1. Comply with legal processes.
2. Enforce these Terms of Use.
3. Respond to claims that such data violates the rights of others.
4. Protect the rights, property, or personal safety of Fedesco, its employees, CRM platform users and visitors, and the public.

You agree that Fedesco may, at its sole discretion and without prior notice, terminate your access to the ClientFlow CRM and/or block your future access to it if Fedesco determines that you have violated these Terms of Use or other associated agreements or guidelines related to your CRM platform usage. You further agree that any violation by you of these Terms of Use constitutes an unlawful and unfair business practice, causing irreparable harm to Fedesco for which monetary damages would be inadequate. In such cases, you consent to Fedesco obtaining any injunctive or equitable relief it deems necessary or appropriate. These remedies are in addition to any other remedies Fedesco may have at law or in equity.

Furthermore, you agree that Fedesco may, at its sole discretion and without prior notice, terminate your access to the CRM platform for cause, including but not limited to:

1. Requests by law enforcement or other government agencies.
2. Self-initiated account deletions.
3. Discontinuance or material modification of the CRM platform or any service offered through it.
4. Unexpected technical issues or problems.

Should Fedesco take any legal action against you due to your violation of these Terms of Use, you agree to pay all reasonable attorneys' fees and costs incurred by Fedesco in addition to any other relief granted to Fedesco. You also agree that Fedesco will not be liable to you or any third party for the termination of your access to the CRM platform as a result of any violation of these Terms of Use.

Governing Law; Dispute Resolution

You agree that all matters related to your access or use of the ClientFlow CRM will be governed by the laws of South Africa. Any claims arising under these Terms of Use must be filed within one (1) year after the cause of action arises, or such claims are barred. Claims made under separate terms and conditions for the purchase of goods and services are not subject to this limitation. You may not seek or receive recovery for damages other than out-of-pocket expenses, except that the prevailing party may be entitled to costs and attorneys' fees. In the event of any dispute or controversy between Fedesco and you arising from or in connection with your use of the CRM platform, the parties shall make a good-faith effort to promptly resolve such dispute. If a resolution cannot be reached within a reasonable time (not exceeding thirty (30) days), either party may submit the dispute to mediation. If mediation fails to resolve the dispute, the parties are free to pursue any available legal remedies under applicable law.

Void Where Prohibited

Fedesco operates the ClientFlow CRM platform from its location in Paarl, Western Cape. While the CRM platform is accessible globally, not all features, products, or services discussed, referenced, provided, or offered through the CRM platform are available to all individuals or in all geographic locations. Some may not be suitable for use outside South Africa. Fedesco reserves the right, at its sole discretion, to limit the provision and availability of any feature, product, or service to specific individuals or geographic areas. Any offers made on the CRM platform for features, products, or services are void where prohibited. If you choose to access the CRM platform, you do so on your own initiative and are solely responsible for complying with local laws.

Miscellaneous

You may not use, export, or re-export any Content, its copies, or adaptations, or any products or services offered on the CRM platform in violation of applicable laws or regulations.

If any provisions of these Terms of Use are deemed void or unenforceable by a court or tribunal of competent jurisdiction, such provisions shall be limited or removed to the minimum extent necessary and replaced with a valid provision that best reflects the intent of these Terms of Use. This ensures that these Terms of Use remain fully effective. These Terms of Use constitute the complete agreement between you and Fedesco regarding your use of the CRM platform, superseding and cancelling any prior written or oral agreements or understandings between you and Fedesco regarding such use, except as provided in a purchase agreement between you and Fedesco. Fedesco will not accept any counter-offers to these Terms of Use, and all such offers are categorically rejected. Fedesco's failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver of any provision or right it has under these Terms of Use, nor shall any course of conduct between Fedesco (ClientFlow system) and you or any other party modify any provision of these Terms of Use. These Terms of Use do not confer any rights or remedies on third parties.

Feedback and Information

Any feedback you provide on this platform is considered non-confidential, and Fedesco is free to use such information without restrictions.

Fedesco Owned Products:

In accordance with this terms of use policy, it is explicitly stated that users of the ClientFlow CRM shall possess no entitlement to revenue generated by the utilization of the CRM or the clients acquired through said utilization, except for the specific rights explicitly granted to them explicitly in writing. These granted rights are subject to revocation at any point in time, solely at the discretion of Fedesco. Fedesco maintains ownership and control over two products, namely, "Credit Score Booster" and "PrePaid Legal," which are exclusively accessible and deliverable via the ClientFlow CRM. Fedesco retains primary creditor status for these products and maintains the exclusive prerogative to provide or withdraw access to users and sellers of these products, exercising this discretion as it deems necessary.
